Annual holiday

Am I correct in thinking you still accrue annual leave whilst on maternity leave? I’m due to return back to work in May and have requested my annual leave total for this year and they have given me my total annual leave allowance from May whereas I assumed I would be owed holiday from January - April also.

Yup! You do. I'm currently on annual leave. I went off work March 2024. I technically returned to work 17th February. But I don't actually return to week until the 2nd week of April because I'm taking some of next yesrs entitlement too

Does anyone know how I can calculate what I should be owed? I was working 4 days a week (25 hours) but will be returning 3 days a week (19 hours) x

If there saying you are getting less it could be cause you are dropping your hours cause otherwise I think you’d owe them, I’m due back October this year so what I’m doing is booking a shift off every week to take me to work just over 19 hours I’ve done this right up till March and when the new tax year comes in April that’s when I’ll drop my hours so I don’t owe anything but still get to enjoy time off even tho it’s not in a block booking x

I work in HR, I can help you calculate it. I’d need to know your usual AL entitlement per year including bank holidays, when you started maternity leave and if you used any AL pre maternity leave xx

Unless you used your full years entitlement before you went on maternity leave any remaining leave entitlement for the year should be carried forward into your return to work unless their policy specifies otherwise (but I don’t think that’s allowed due to equality) x

You accrue your holiday based on your 4 days/week until the point you have your new contracted 3 days/week job so anything you would of had whilst off should be as you would have calculated it before. Just moving forwards it will be reduced.

You accrue as you would normally for a four day working pattern while on maternity leave but going forward you'd only accrue holiday for a three day working pattern so it's less. That might be part of why it's different. Get them to break it down for you!

@Emma what about the AL that was not used before the maternity leave? Does that also get added to the number of days that can be used upon coming back to work?

@Alla yes, you’d add that to the total. My holiday year runs from January to December. I finished at Christmas & used all of 2024 AL but am owed the whole of 2025s allowance (including bank holidays) & some of 2026s allowance plus partial bank holidays xx

@Emma thank you! I believe it was 15 days + 8 bank holidays for the year. Started Mat leave 1st August 2024 & used all my 2024 holiday allowance before I went on mat leave x

When does your holiday year run to/from? If it’s Jan-December you will not be owed any days for 2024 other than the remaining 2024 bank holidays (26th August, Christmas Day & Boxing Day = 3 days for 2024) as you said you used the standard AL before going on maternity leave. Then for 2025 of your taking the full year maternity leave the calculations are: 15 days / 12 = 1.25 x 7 (to the end July) = 8.75 days (rounded up to 9 days) plus the 2025 bank holidays for 1st Jan, 18 April, 21 April, 5 May, 26 May = 5 days) so in total you are owed 3 days for 2024 & 14 days for 2025 = 17 days total accrued while on maternity leave - does that help? Xx
